Rishikesh property documents checklist
Updated · rishikeshproperty.com/buying-guide/documents-checklist
Use this checklist when you shortlist a plot, house, villa, flat or guest house in Rishikesh. Print it, take it to site visits and go through it with your lawyer. It expands the documents list in our buying guide for outside & NRI buyers.
Important: This is a general checklist, not legal advice, and not every item applies to every property. Laws and procedures in Uttarakhand change, so have an independent property lawyer verify every document before you sign or pay anything.
1. Ownership and title
- Sale deed / title deed of the current owner
- Chain of earlier deeds showing how ownership passed to the seller (ownership history)
- Seller's identity documents, matching the names on the deeds
- If the seller inherited the property: documents showing the inheritance and consent of all legal heirs
- If someone signs on the owner's behalf: the power of attorney, checked by your lawyer
2. Land records
- Khatauni (record of rights) showing the seller as owner
- Mutation record in the seller's name
- Encumbrance status: no loans, mortgages, liens or court disputes on the property
3. Land use and restrictions
- Land-use / zoning category (residential, commercial or agricultural)
- Whether you are eligible to buy this category of land (rules differ for buyers from outside Uttarakhand, NRIs and OCI cardholders)
- Whether the land falls in a forest, eco-sensitive or riverbed-restricted zone
- For hospitality use (homestay, guest house, hotel): the land use and approvals the business will need
4. Built property (house, villa, flat, guest house)
- Approved map / building plan from the competent authority
- Built structure and number of floors match the approved map
- Completion status for newly built property
- For a flat: who maintains common areas, water, power backup and parking
5. Projects and layouts
- RERA registration for projects that require it (search the Uttarakhand RERA portal)
- Layout approval where a plot is part of a colony or layout
6. Bills, dues and tenancy
- Up-to-date property tax receipts
- Up-to-date electricity and water bills, with no pending dues
- For rented property: the tenancy agreement and proof of the rent actually being paid (rent shared by an owner is not guaranteed)
7. Site checks
- Plot measured on site and matched with the documents and boundaries
- Approach-road width, and whether it is a public road
- Water, electricity and drainage connections
- Monsoon flood or landslide risk (ask locally, especially on slopes and near the river)
- Neighbours asked about any boundary or ownership disputes
8. Paying and registering
- Written agreement for any token or advance, reviewed by your lawyer
- All payments by traceable bank transfer (NRIs: through proper channels such as NRE/NRO accounts)
- Current stamp duty and registration charges confirmed with your lawyer or the sub-registrar office
- Registration at the relevant sub-registrar office
- Mutation applied for in your name after registration
